Terms & Conditions

These are the terms that apply when you engage us for building work — how quotes, payments, variations and warranties work. We've written them to be readable, not defensive. If anything is unclear, ask us.

About these terms

These terms govern the contract between TB&D Construction Ltd (“TB&D”, “we”, “us”) and you, the customer, for any building work we carry out. They sit alongside the written quote we provide for your specific project.

If anything on your quote conflicts with these terms, the quote wins. Anything else we’ve agreed in writing (email counts) forms part of the contract.

Quotes & estimates

Quotes are free, itemised and delivered within 48 hours of a site visit. They’re valid for 30 days unless we say otherwise in writing.

A quote is a fixed price for the scope described. An estimate is an educated guess — we’ll clearly mark which one you have. If hidden conditions (rot, leaks, unsafe wiring, unexpected structural issues) come to light during the works, we’ll price the extra before carrying it out.

Accepting the quote

The contract starts when you confirm acceptance of the quote in writing (email or signed document). We’ll agree a start date in the same message thread.

For larger projects, we may require a deposit before ordering materials. The deposit amount and schedule will be set out in the quote.

Payment

Payment terms are set out on the quote. Typically:

  • Small jobs: invoice on completion, payable within 7 days
  • Medium jobs: 30% deposit, 40% mid-stage, 30% on completion
  • Large projects: weekly or fortnightly stage payments against signed-off milestones

Invoices are sent by email. Payment is by bank transfer to the account stated on the invoice — we never request payment to a different account by text or call. Late payments incur interest at the statutory rate (Bank of England base rate + 8%) under the Late Payment of Commercial Debts legislation.

Site access & your responsibilities

You agree to give us:

  • Reasonable access to the property during agreed working hours (typically 8am–5pm weekdays)
  • Access to water, power and toilet facilities for the duration of the work
  • A clear working area — furniture moved and breakables removed where relevant
  • Any permissions from freeholders, neighbours or managing agents that are needed for the work

If access is delayed by circumstances within your control, we may charge a day rate for lost time, stated on the quote.

Materials & workmanship warranty

Materials are sourced as specified on the quote. If a product is unavailable by the time we order, we’ll propose a like-for-like alternative for your approval in writing before ordering.

All workmanship is guaranteed for 12 monthsfrom the date of completion. Manufacturer warranties on specific products (boilers, appliances, fittings) are passed through to you directly — we’ll register them where applicable.

Gas work is carried out by our Gas Safe registered engineering partner and covered by their own Gas Safe certification.

Variations

If you want to change the scope mid-project (add a wall light, swap a tile spec, extend the worktop), no problem — we’ll price the variation in writing before carrying it out.

Variations are payable alongside the next scheduled stage payment unless agreed otherwise.

Timescales

Start and completion dates on the quote are targets based on the scope as agreed at the time. They may shift if:

  • Variations are added mid-project
  • Hidden conditions require remedial work
  • Specified materials are delayed by the manufacturer
  • Access is delayed
  • Exceptional weather (for external works)

If a delay is within our control, we’ll tell you as soon as we know and agree a revised timeline.

Insurance & liability

We hold public liability insurance of £2 million. Certificates available on request before works begin.

We are liable for damage caused by our negligence during the works. We are not liable for:

  • Consequential losses (lost income, alternative accommodation costs)
  • Damage caused by pre-existing defects in the property
  • Damage caused by materials or fittings supplied by you or a third party

Nothing in these terms limits our liability for death or personal injury caused by negligence, or for fraud, or anywhere the law doesn’t permit limitation.

Cancellation

You can cancel within 14 days of accepting the quote without charge — the right applies under the Consumer Contracts Regulations if the contract was made at a distance or off-premises.

After the 14-day window, or if work has already started with your express request, cancellation charges apply:

  • Reasonable costs of materials already ordered
  • Labour already carried out at the quoted rate
  • A fair contribution to lost booked time (up to 10% of the remaining contract value)

We may cancel the contract if you breach these terms materially (non-payment, denying safe access, etc.) and haven’t remedied it within 14 days of being asked in writing.

Complaints

If something’s not right, tell us. Email team@tbdconstruction.co.uk with the details and any photos. We’ll acknowledge within 2 working days and aim to resolve within 14 days.

If we can’t reach a resolution, you can escalate through the dispute resolution service offered by Checkatrade (we’re verified members, 9.92/10 rated).

Governing law

These terms and any contract formed under them are governed by the law of England & Wales. Any dispute not resolved informally or through Checkatrade’s service falls within the exclusive jurisdiction of the courts of England & Wales.
